MEMORANDUM OPINION
SUE L. ROBINSON, District Judge.
I. INTRODUCTION
Plaintiff Girafa.com, Inc. (“Girafa”) initiated this patent infringement suit pursuant to 35 U.S.C. § 271 on December 5, 2007, alleging that defendant Smartdevil Inc. (“Smartdevil”), among others, infringed upon U.S. Patent No. 6,864,904 (“the '904 patent”). (D.I. 1) Although Girafa’s complaint named nine defendants (collectively, “defendants”), all but Smartdevil have since been dismissed.
