WAEEACE, Circuit Judge.
The plaintiff in error was the pláintiff in the court below, and brings this writ of error to review a judgment for the defendants. The action was brought to recover money alleged to have been received by the defendants as copartners in the law firm of De Forest & Weeks, being the proceeds' of a mortgage owned by Mary E. Birckhead, the plaintiff’s testatrix, which was foreclosed by De Forest & Weeks as her attorneys.
