MEMORANDUM OPINION
JAMES G. MIXON, Bankruptcy Judge.
Randolph Kerr (debtor) filed a voluntary petition for bankruptcy under Chapter 7 of the Bankruptcy Code on July 27, 1984. The plaintiffs • filed an objection to discharge pursuant to 11 U.S.C. § 727 and a complaint to determine dischargeability pursuant to 11 U.S.C. § 523. In the complaint, the plaintiffs alleged that the debtor should be denied discharge for the following reasons. First, the plaintiffs’ objection alleged that the debt owing to plaintiffs was “incurred through fraud and defalcation while acting in a fiduciary capacity.”…
