The Department of Public Works and Buildings of this State filed its petition in the county court of Carroll county under the act of June 22, 1917, known as the Sixty Million Dollar Road Bond Issue act, (Laws of 1917, p. 696; Ca-hill’s Stat. 1925, p. 2101;) to ascertain the just compensation to be paid certain land owners for right of way to constitute a part of.Route No. 40 as defined in the act.
