This action was brought for damages resulting from plaintiff’s colt being injured by coming in contact with a barb wire fence, which was alleged to have been a nuisance and to have been negligently maintained by the defendant. The court below rendered judgment for the plaintiff. The plaintiff had placed-his colt to pasture on the pasture lot of his brother, a short distance from defendant’s lands.
