ORDER OF DISMISSAL
KANE, District Judge.
This civil rights case originated on April 26, 1986, in the District Court for the City and County of Denver. It was removed to federal court by defendant on June 10, 1986, pursuant to 28 U.S.C. § 1442(a). This matter is now before me on defendant’s motion to dismiss, or, in the alternative, for summary judgment. Jurisdiction is based on 42 U.S.C. § 2000e et. seq. al though defendant maintains there is no subject matter jurisdiction.
