For the purpose of disposing of the questions presented upon this record, we may take certain propositions as settled. The land over which are the street and sidewalk upon which plaintiffs reside was the property of the grantor of the plaintiffs. By condemnation proceedings duly had, the City of Asheville acquired an easement over Raid land for the purpose of enabling it to open and maintain a public street and sidewalk for the use of the citizens of Asheville.
