Appeal from an order of the Supreme Court (Krogmann, J.), entered January 4, 2016 in Warren County, which, in a proceeding pursuant to Business Corporation Law article 11, determined to use a certain methodology to distribute the income of Springs Aesthetic Plastic Surgery, PC.
Petitioner and respondent (hereinafter collectively referred to as the doctors) are plastic surgeons and were friends. Respondent began practicing prior to petitioner, and the two contemplated forming a joint practice after petitioner completed his training.
