Appeal from an order of Supreme Court at Special Term entered in Schoharie County on June 27, 1968. The order appealed from determines motions made by both parties. On July 28, 1966 Gerald T. Yaccaro, appellant’s insured, was operating an automobile which caused injuries to the infant respondent, a passenger therein. The respondents commenced an action against Yaccaro for personal injuries; the appellant disclaimed coverage and refused to defend; a default judgment was granted tpj the infant and his father.
