— This was an action, in the Allen Circuit Court, by the appellees against the appellants to recover damages alleged to have accrued to the appellees on account of the breach of a contract to convey real estate. Coupled with the action to recover damages was an action to set aside a fraudulent conveyance.
The contract was dated on the 11th day of March, 1887, and stipulated that the appellant Jeremiah Nesbit should convey by warranty deed to the heirs of John M. Miller, deceased, by name, a certain described forty-acre tract of land in Allen county for the consideration of twenty-three hundred…
