I concur because I feel bound to follow this court’s precedent finding Section 39.-061, Florida Statutes (Supp.1990), unconstitutional as an invalid delegation of legislative authority in contravention of the separation of powers provision of Article II, Section 3, Florida Constitution.1 See D.P. v.
