On March 10, 1987, Gull Air, Inc. (“Gull Air” or the “Debtor”) filed a voluntary petition for relief under Chapter 11 of the Bankruptcy Code. Less than two weeks later, on March 19,1987, the First National Bank of Dubuque (the “Bank”) filed an emergency motion for relief from stay, seeking possession of an aircraft identified as an Embraer Model EMBA 110-P1, License Number N870AC on three alternative grounds: 1) that the Bank had leased the aircraft to Gull Air and the lease had expired; 2) the Debtor was unable to insure the aircraft so the aircraft…
