Per Curiam,

Relator, convicted of second degree murder in Fulton County in 1950, was sentenced to the Western State Penitentiary for a term of not less than 10 nor more than 20 years. Since then he has filed several petitions for writs of habeas corpus in the Court of Common Pleas of Fulton County and in thé United States District Court for the Western District of Pennsylvania, all of which were dismissed.

On relator’s present petition for a writ of habeas corpus the court issued a rule on the District Attorney to show cause and fixed a time for hearing thereon. The court appointed…
