Appeal by the plaintiff, Peter 0. Hendrickson, and by the defendant The City of New York, from a judgment of the Supreme Court in favor of the defendant the Jamaica Electric Light Company, entered in the office of the clerk of the county of Queens on the 23d day of July, 1898, upon the decision of the court rendered after a trial at the Queens County Special Term dismissing the complaint upon the merits.

This is a taxpayer’s action brought to annul a contract alleged to, have been entered into on the 17th day of December, 1897, between the town of Jamaica and the Jamaica Electric Light Company, for furnishing electric lights to a designated lighting district in that *481town for a period of ten. years from, the date of the contract.
