FISHER, Chief Justice.

— This is a suit by Annie Sullivan, filed in November, 1905, against the appellant as the executor of the will of William Sullivan, deceased, to have set apart to her certain real estate, known as lots 6 and 7, in block 25, in the city of Houston, as her homestead, and a year’s allowance or exempt personal property in lieu thereof, and exempt personal property to which she is entitled as thé head of a family or an allowance in lieu thereof, and for the recovery of $150 against the estate of William Sullivan, deceased, due physicians by said estate for medical attention…
