Appeal from an order of the Supreme Court (Scarano, Jr., J.), entered May 15, 2003 in Saratoga County, which granted plaintiffs cross motion to modify a judgment of divorce.

The parties, divorced in 1999, have one son, born in 1987. Pursuant to a stipulation of settlement incorporated by refer*711ence into a judgment of divorce, the parties shared joint legal and physical custody of the child on an alternating week basis.
