The plaintiff sues for the price of a certain tailoring stock which he sold and delivered to the defendant. the defendant admits the purchase, but states that the sale of the stock was part of a transaction wherein the defendant for the sum of $15,000 purchased the real estate of the plaintiff with the good will and fixtures of the tailoring establishment conducted thereat by the plaintiff. (the price of the stock was separately fixed; but not included in the $15,000), that at the time be made the sale the vendor misrepresented the condition and extent of the business,…
