The circuit court in this case, in effect instructed the jury to find for the respondent. In view of the tax deeds offered in evidence by the appellant, particularly the one dated August 18th, 1845, in connection with proof of possession by him, this ruling was contrary to the decision in Edgerton vs. Bird, 6 Wis., 527. That tax deed was recorded in August, 1845, and it appeared that the appellant had been in the actual and open possession of the premises under that deed and others, since 1848.
