The defendant was charged, under section 11500 of the Health and Safety Code, with the unlawful possession of marijuana cigarettes. He pleaded guilty, and was sentenced to state prison. He subsequently claimed that he was induced to waive counsel and to plead guilty by the fraudulent representations of the narcotic officers that if he did so he would be imprisoned in the county jail, only, for a period of 90 days, and not be sentenced to state prison. He moved to set aside the judgment of conviction on that ground. The motion was denied. From that order this appeal was perfected.
