This is an action in quo warranto to test the effectiveness of the gubernatorial appointment of a county commissioner.

Briefly, the salient and stipulated facts are: A duly elected county commissioner of Kitsap County died, thereby creating a vacancy on that board of county commissioners. The remaining county commissioners, being of different political faiths, were unable to agree upon and appoint a successor.
