Appeal by both, parties from Allen, J., at chambers, in Kinston, 12 September, 1918, from a judgment upon an agreed state of facts in a controversy submitted without action.

It appears from the agreed statement of facts that on J. November, 1913, Nina A. Kilpatrick, being the owner in fee simple of a tract of land, conveyed the same, with the written assent of her husband, to one B. W. Waters by deed duly recorded, and that “on the same day and as a part of the same transaction,” the said B. W. Waters executed nine bonds for the purchase price of the land, one falling due each year, and made them payable to the said Nina A. Kilpatrick and her husband, each for the sum of $200, and to secure the same executed a mortgage on the said tract of land.
