The case of Oscar Patrick, plaintiff, against defendant, Burgess-Norton Manufacturing Company, seeking to recover damages for personal injuries allegedly resulting from defendant’s violation of the Structural Work Act, was set for trial in the circuit court of Kane County on February 13, 1973. Plaintiff and his attorney did not appear. The circuit court impaneled a jury, and the case proceeded to trial.
