Pro se petitioner Hemachal Somir (“Somir”) is a native of Guyana who has sought relief from this court against the actions of the Bureau of Immigration and Customs Enforcement (“BICE”) in two separate petitions. The first petition, filed with this court on July 9,'2004 (“July 9 Petition”), asks this court to suspend enforcement of a 1998 exclusion order (“1998 Order”), pursuant to which Somir initially was detained by immigration officials.
