Background

On July 25, 1989, a federal grand jury returned a single count indictment against defendant Robert Paleo for possession of a firearm in violation of 18 U.S.C. § 922(g)(1) (forbidding convicted felons from possessing firearms). Subsequently, on August 9, 1989, the government filed notice that it would seek an enhanced sentence under 18 U.S.C. § 924(e) (providing a minimum 15 year sentence for anyone with three prior violent felony convictions who is convicted of violating § 922(g)(1)).
