This is an appeal by defendants Cunningham and Hecht from their jury convictions for possession with intent to distribute and distribution of approximately 800 pounds of marijuana in violation of 21 U.S.C. Sec. 841(a)(1).

Defendants were arrested as they completed delivery of a large quantity of marijuana to two undercover officers who, acting on information received from an informer, had posed as buyers. Subsequently, they were indicted on five counts of violating 21 U.S.C. Sec. 841(a)(1). Defendants agreed with the government that they would plead guilty to…
