This case comes up on a demurrer to the declaration.
The suit is to enforce an alleged liability accruing under the provisions of the Federal Employers’ Liability Act to recover for the death of John W. Bradford, a railroad employee, who was negligently run over and killed by the defendant’s locomotive when engaged in an interstate movement in the defendant’s yards in the City of Balti*823more.
