Dow Chemical Company (Dow) sued Ogletree, Deakins, Nash, Smoak & Stewart (Ogletree) for legal malpractice, alleging that Ogle-tree negligently handled a federal lawsuit that resulted in a $2,450,000 judgment against Dow. Among other things, Dow alleged that Ogletree negligently failed to file a timely appeal of the jury’s verdict. Both parties moved for partial summary judgment on the issue of Ogletree’s liability for its failure to file a timely appeal.
