In an action involving multiple claims and parties, defendant Financial Security Insurance Company, Ltd. (FSIC) appeals from the order granting plaintiff Richard Arimizu (Arimizu) a summary judgment on his complaint.

The issues on appeal are (1) whether there are genuine issues of material fact in the record so that summary judgment was improper; (2) whether the circuit court erred in awarding Arimizu an amount equal to his wage claim as a civil penalty under Hawaii Revised Statutes (HRS) § 388-10; and (3) whether the circuit court abused its discretion by…
