PER CURIAM: *

A jury convicted Willard Allen of the capital murder of Herman Ferguson, and Allen was sentenced to death. The Louisiana Supreme Court denied relief in Allen’s direct appeal, and his request for habeas relief in the state courts was denied. In federal habeas proceedings pursuant to 28 U.S.C. § 2254, the federal district court granted relief and ordered a new trial. The State has appealed that judgment, and its appeal is pending. Allen has filed a cross-appeal in this court seeking a certificate of appealability (COA) on nine issues on which the federal district court denied…
