Error from, Leavenworth District Court. Action by Henry H. Houston, against John Hannon, and the Board of County Commissioners of Leavenworth county, to recover the moneys due on four certain bonds issued by said county of Leavenworth on the 1st of August 1865. Plaintiff alleged that the bonds belonged to him, and that they had been unlawfully converted by the defendants. The facts are fully stated in the opinion, infra.

This was an action on four certain bonds issued by Leavenworth county to the Union Pacific Railway Company. These bonds are part of the same issue of bonds as those which were held to be valid and binding obligations against the county of Leavenworth in the cases of Leavenworth County v. Miller, 7 Kas. 479, and Leavenworth County v. Higginbotham, 17 Kas. 62; and nothing therefore need be said in this case with regard to their validity.
