A great many questions have been argued by counsel in their briefs which it will not be necessary to determine in this cause. As we view the case, the motion to dismiss the petition in error is well taken, and the other questions argued will only arise for our consideration on appeal from a judgment on the merits, or at least from a final judgment in the case.
