Harvey, J.:

Appellant was tried and found guilty of the sale of chattel-mortgaged property of the value of more than $20 with the felonious intent to cheat and defraud the mortgagee. Because of his previous conviction of a felony he was sentenced to the penitentiary for a term of not more than ten years. This was June 20, 1936, on which date his motion for a new trial was overruled, and on this sentence he was committed to the penitentiary. On June 17, 1938, he served and filed his notice of appeal.
