When this ease was remanded under the re-script in Wellman, Admr. v. Wales, 97 Vt. 245, 122 Atl. 659, the defendant sought and was granted a change of venue, and the retrial was in the Windsor county court. At the close of the plaintiff’s evidence, the defendant moved for a directed verdict. This motion was granted and the plaintiff excepted. This exception presents the only question relied upon in this Court.
