This action is founded upon an alleged verbal agreement under which the plaintiff claims that the defendants’ testator promised to pay him the sum of $100,000 during the lifetime of the testator, or to leave him that sum in his will, as compensation for services alleged to have been rendered in the capacity of a veterinary surgeon. The jury rendered a verdict in favor of the defendants, and upon appeal the judgment entered upon that verdict was affirmed by the Appellate Division.
