It is agreed by plaintiffs-appellants that the defendants-appellees’ statement of the case is correct, and so far as pertinent to the questions herein we adopt the same. This is an appeal from the ruling of the trial court sustaining the motion to dismiss, filed by the defendants to the plaintiffs’ petition.
