The plaintiff has appealed from an order quashing an execution on the ground that the judgment debtor was relieved from liability by a subsequent adjudication of bankruptcy.
The plaintiff and defendant were formerly husband and wife. There are three children as the issue of that marriage. The spouses were possessed of community real and personal property. The plaintiff commenced a suit for divorce against the defendant, praying for a dissolution of the marriage and for alimony, maintenance and counsel fees. An order for alimony pendente lite was made.
