Mrs. B. O. Dempsey sued the Glens Falls Indemnity Company for a breach of the official bond of H. C. Shelby, sheriff of Walker County, on which bond the defendant was surety. The plaintiff sought $3000 damages which she alleged had been caused by the official misconduct of the sheriff and of Tobe Beard, a deputy sheriff of such county.
