This case has come before us by virtue of garnishment proceedings instituted by plaintiff-owner of a clothing store at Oxford Valley Mall, seeking recovery for losses which resulted from certain water damage which occurred when a uniform store situated immediately above plaintiffs store in the mall was destroyed by fire. That fire was the result of a July 30,. 1974 arson by individual defendant Bruce Howard Kates, who was subsequently convicted of that crime; Plaintiffs garnishment is directed against proceeds of a certain insurance policy issued by Pennsylvania National Mutual…
