Reversing.
The appellant, Hall, was the nominee of the Republican party for Justice of the Peace in magisterial district No. 6, of Perry county, and as such his name was printed upon the ballots used at the regular November election, 1921, under the device of that party. The appellee, Sumner, was not a candidate of any party, and his name was not printed upon the official ballots.
