The action is one to recover damages for the alleged negligence of the defendant. The plaintiff asks us to disregard the appeal for the reason that the assignments of error do not comply with General Statutes, § 5837. The assignments of error are all of the same form, for example: “Whether the trial court erred in admitting the testimony,” etc. The assignments are not in proper form. On at least four occasions we have disapproved of assignments beginning, “Whether or not the court erred,” or “Whether the court erred.” McCaskey Register Co. v.
