1Opinion of the CourtGarrigues, J.
March 26, 1912, information was filed against Edward Siewald and Oscar Cook charging them with murder. At a joint trial Cook was convicted and sentenced to be hanged, and Siewald sent to the penitentiary. We reversed the case as to Cook, and granted a new trial, upon the ground- that he was entitled to a severance because their defenses were *265antagonistic, and the confession. of Siewald was not admissible against Cook. See Cook v. People, 56 Colo. 477, 138 Pac. 756. October 16, 1914, Cook was placed on trial separately on this information, and the jury returned a verdict finding him guilty of…
