Given the troubling procedural history of this case, I dissent from this Court’s decision not to hear the case en banc. The Texas Rules of Appellate Procedure allow a justice of the court of appeals to request a vote to determine whether a case will be heard en banc. See Tex.R.App. P. 41.2(c).
