Proceeding pursuant to CPLR article 78 to review a determination of a designee of the Commissioner of the New York State Department of Health, dated January 22, 2009, which, after a fair hearing, affirmed a determination of the Nassau County *942Department of Social Services to discontinue the petitioner’s personal care services pursuant to 18 NYCRR 505.14.
