This action is before this Court upon the appeal of Independence Coal Company, Inc., (hereinafter “Independence”) from two orders of the Circuit Court of Boone County entered on September 22, 2009, denying Independence’s renewed motion for judgment as a matter of law or, in the alternative, for a new trial. The orders were entered follow ing a jury verdict finding Independence negligent and awarding the plaintiff, Stanley Stevenson (hereinafter “Stevenson”), $1,968,952.61 in compensatory damages for an injury to his wrist and arm.
