The plaintiff brought an action for damages against the defendant alleging that the plaintiffs automobile was struck by an automobile being driven by Mary Louise Clements; that the automobile was owned by the defendant and "was being operated by his wife, Mary Louise Clements, with his knowledge and consent. Said automobile was owned by the defendant for family uses and purposes.”
