GRAY, Circuit Judge.

The case before us arises out of an action in the court below for personal injuries sustained by the plaintiff below (plaintiff in error), on a grandstand controlled by the defendant below (defendant in error), at the Forbes Field Baseball Park, in the city of Pittsburgh.

On the afternoon of September 16, 1911, plaintiff, having paid his admission, was going along a passageway on the first floor of the grandstand, toward the elevators, to be taken up to his box in one of tlie galleries.
