COFFIN, Chief Judge.

This appeal presents several questions concerning federal practice and procedure. Plaintiffs, Eugene and Elizabeth Eisler, instituted this action, relying for jurisdiction solely upon diversity of citizenship, to recover damages they allegedly suffered in various business and securities transactions with defendant, Nathan Stritzler. Defendant admitted diversity of citizenship in his pleadings, but subsequently was defaulted for failing to obey the district court’s order that he give a deposition.
