This is a suit in equity brought for the purpose of establishing liability on the part of the county of Erie to the town *542of Amherst, to pay to the town the amount of the taxes assessed against property in the town of Amherst for general town purposes and for local or special district assessments in the town which were returned by the town receiver of taxes to the county treasurer as uncollected in the year 1931, and on account of which the property against which the assessments were spread was put up for sale by the county treasurer at the annual tax sale in that year, which properties were…
