This case had its inception in the court below in an action for damages growing out of an explosion of a hot water heater installed in a new house then under construction in Dumas, Texas, by appellee John Farrell, d/b/a John Farrell Lumber Company. The heater was manufactured by Rheem Manufacturing Company, a defendant in the court below along with appellant, Patrol Valve Company. The case was tried to the court.
