OPINION AND ORDER

LAFFITTE, District Judge.

On September 27, 1995, the Court issued an Opinion and Order (1) denying Defendant’s motion to dismiss because the Court had subject matter jurisdiction over Defendant under 28 U.S.C. § 1330 (1996), (2) granting Defendant’s motion for summary judgment on Plaintiffs contractual claim, and (3) denying Defendant’s motion for summary judgment on Plaintiffs negligence claim under Article 1802 of the Puerto Rico Civil Code.
